These General Terms & Conditions of Sale (GTCS) are agreed between:

Firstly, the company Groupe COURIR, a simplified joint-stock company with a registered capital of65 675 047,95 €, having its registered office at 91 avenue Ledru-Rollin, PARIS (75011), France, the PARIS T.C.R. unique identification number of which is 843 726 704, hereafter referred to as the "Company".

and, for products concerned by the Partner Programme, the company Adidas France S.A.R.L. having its registered office at 1 Allée des Orcades, Strasbourg (67000), France, the Strasbourg T.C.R. identification numbers of which are: B 085 480 069 - Admin. number: 89 B 180 - VAT registration number, France: FR58085480069, hereafter referred to as the "Partner".

And any other natural person visiting or making a purchase via the www.courir.com website or placing an order through a vendor in a Courir store (excluding Outlets) via the said www.courir.com website, from France, hereafter referred to as the "Surfer" or the "Customer").

ARTICLE 1 – PURPOSE

The purpose of these terms & conditions is to define the conditions and methods governing distance selling between COURIR and the Surfer, including the placing of orders, services and payment, and the delivery or return of ordered goods. They govern all stages necessary to placing and tracking the order between the contracting parties on the www.courir.com website.

The purpose of the www.courir.com website is to market and sell products exclusively at retail to final consumers for personal use, without resale. Groupe COURIR therefore reserves the right to refuse or cancel any order that does not correspond to a retail sale to a final consumer and/or in the event of an abnormal request, particularly in the case of an order for unusual quantities and/or amounts for a consumer.

This order may be placed directly by the Surfer on the www.courir.com website or via the vendor in a store on a Customer's behalf using the store's online ordering interface. The Customer may then receive his/her items at the address of his/her choice or at the store, as he/she would when ordering normally via the www.courir.com website.

The placing of an order implies full and entire acceptance by the Surfer of these general terms & conditions of sale. The Surfer confirms that he/she possesses the legal capacity to enter into this Contract, i.e. that he/she has reached legal age and is not under any wardship or guardianship arrangement. The Surfer also states that he/she is not purchasing COURIR products and items within view to reselling them. These General Terms & Conditions of Sale contain all of the reciprocal commitments of the Company and Customer, who expressly accepts them.

Courir reserves the right to adapt or modify these general terms and conditions of sale at any time for legitimate reasons. In the event of modification, the general terms and conditions of sale in force on the www.courir.com website on the date the order is placed by the Surfer shall apply. However, if any condition is overlooked, it will be considered as being governed by the applicable customs and practices used in the remote selling sector for companies having their registered office in France.

ARTICLE 2 - OUR RANGE

www.courir.com is a website offering for sale sport and leisure items, clothing and personal clothing items, sporting or leisure equipment and accessories.

The items proposed for sale by Courir are those displayed on the www.courir.com website on the date it is visited by the Surfer. All product ranges and delivery terms are valid for metropolitan France. Orders may be delivered to Corsica subject to certain conditions described hereafter.

In accordance with the provisions of the French consumer code, before placing his/her order the Customer may familiarise him/herself with the essential characteristics of the products proposed on the Website which he/she intends to order based on the corresponding product information sheets.

As the products are constantly changing, it is hereby stipulated that manufacturers may modify the technical composition and characteristics of listed products without notice.

The range of products proposed on the Website may be different from that proposed in the COURIR'S physical stores.

ARTICLE 3 – AVAILABILITY

The Customer may select one or several products from among the different categories proposed on the Website. It is hereby stipulated that the Company may modify the selection of products proposed on the Website at any time without prejudice to any orders placed by the Customer. It is impossible to prepare a single order including both products listed in the Partner Programme and products not in the programme.

The product ranges and prices are valid for as long as it is possible to confirm the order. If it is found after the order has been placed that a product is unavailable for any reason – temporarily out of stock (in the case of orders placed simultaneously for example) or the permanent non-availability of the said product – this will not result in the total cancellation of the order but only the cancellation of the product(s) concerned with the available product(s) still being shipped. The Customer will be informed of this by email rapidly.

The Customer will only be debited for an amount equivalent to the price of those products actually shipped, without this affecting any promotions and offers applied when the order was placed (for example, if one of the two T-shirts in the "2 T-shirts for €30" offer is no longer available, the T-shirt actually shipped will be billed at €15.00), nor the calculation of the delivery costs.

The Customer is hereby informed that the order is considered as cancelled for products unavailable at the time of shipment, with the result that the Customer may not avail him/herself of his/her rights concerning the said products should they become available on the Website once again. .

Courir reserves the right to limit the number of purchases per customer and/or per order for certain items. This restriction may be applied at its discretion and without prior notice.

ARTICLE 4 – PRICES

The prices displayed on the Website are displayed in euros (VAT-inclusive) by default and apply in metropolitan France and in all countries eligible for delivery from www.courir.com.

The prices practised on the e-commerce website are independent of the prices practised in the Courir stores.

VAT is applied at the rate in force on the date on which the order is placed.

The product prices displayed on the Website exclude carriage costs unless stated otherwise.

The price displayed at the time of a request for an e-reservation on www.courir.com is the price that will be paid for the item reserved in-store by the surfer subject to the confirmation of the request by the selected store.

The Company reserves the right to modify the prices of its products at any time but undertakes to apply the prices in force at the time the order was placed by the Customer subject to the availability of the products on this date.

The products remain the property of the Company until payment in full by the Customer. Nevertheless, the risks will be transferred to the Customer as from the receipt of the order.

• Offers and promotional codes

In the case of promotional offers, the prices shown are valid during the offer period, and on the sites concerned by the offer.

Several promotional offers may apply in the same shopping cart but only a single promotion shall apply to each product. Another promotional offer will only apply to non-discounted products.

If you have a promotional code which is valid on our website www.courir.com, we invite you to enter it in your shopping cart in the box which appears when you click the link "Do you have a reduction code?" Then click "Apply".

• Exclusions: The Partner Programme and raffles by EQL

The products listed in the Partner Programme and products reserved for the EQL by Courir raffles are excluded from the promotional offers proposed on the COURIR website and COURIR or partner coupons and gift cards cannot be used for these products. The Partner Programme's products are subject to specific promotional offers identified as such by a special badge.

ARTICLE 5 – ORDER

5.1 Provisions:

Any order placed on the Site (whether by the Internet user directly or with the help of the sales assistant in-store via the web shop ordering interface) implies express and unreserved acceptance of these Sales General Terms and Conditions.

The purpose of the www.courir.com website is to market and sell products exclusively at retail to final consumers for personal use, without resale. Therefore, Groupe COURIR reserves the right to refuse or cancel any order that does not correspond to a retail sale to a final consumer and/or in the event of an abnormal request, particularly in the case of an order for unusual quantities and/or amounts for a consumer.

Any order made by bots or resellers will result in the cancellation of the customer’s account.

The purpose of the www.courir.com website is to sell products intended for individuals who use them for personal purposes and who do not resell them. The Groupe COURIR company therefore reserves the right to refuse or cancel the sale of products to other retailers or resellers.

Courir also reserves the right to temporarily exclude a city or country from access to purchase on the courir.com site, if the retailer deems that opening up to this country is detrimental to its business for a given period in an exceptional case. This is particularly the case for Germany, which will be excluded from our delivery countries when high-demand products are launched.

To place an order on the www.courir.com website or with the help of a sales assistant in-store via the web shop order interface, the Customer must create a Customer account, or use an existing account.

When placing his/her first order, an Internet user, whether or not in possession of a myCOURIR card, has the option of creating a customer account or continuing as a Guest.

There are two ways to create a customer account:
• either by clicking on the “I already have an account” button on the identification page during the order process
• by clicking on the “I’m connecting with Facebook” button on the identification page during the order process; or

If the order is validated with a Guest account, the Customer will be able to finalize the creation of his/her Customer account:
• On the order confirmation page.
• By e-mail, before the order is shipped. Once the parcel has been shipped, this link will no longer be valid.

In both cases, the Customer is redirected to a registration form.

Once the account has been created, the Customer will have access to his/her Customer area entitled “My Account” located at the top right-hand corner of the site. Access to this Customer Area is subject to the Customer’s identification using his/her e-mail address or Facebook account, as indicated when the account is created, and the selected secret and personal password.

The Company may not be held liable for any action carried out in the Customer area by a third party to whom the Customer has communicated his/her identifiers or who has gained access to the account as a result of negligence on the part of the Customer.

All information relating to the order can be consulted in the “Orders” section of the Customer area.

Ordering as a Guest.

You do not need to create an account to place an order as a Guest. By choosing this method, the Customer will be redirected to an information form required to finalize and ship the order. However, if an existing Customer account is identified with the same e-mail address, logging in to that account will be compulsory.

The Customer may finalize his/her order as a Guest, whether it is his/her first order or not. However, a Guest account does not entitle you to the benefits of the loyalty programme.

An order confirmation e-mail will be sent to the Customer once the order has been placed. The Customer will be asked to create a customer account to track his/her order.

All information relating to orders placed in Guest mode will be sent exclusively by e-mail. It is therefore important to keep such information. Without a customer account, the Customer will be unable to consult this information in a customer area on the site which includes details of the order, order tracking and the possibility of creating a return slip if necessary.

This link for the creation of a return slip cannot be provided a second time by COURIR. Once the withdrawal period has expired, the link will no longer be valid and it will be impossible to return the goods.

Finalizing the order

The Internet user undertakes to ensure that the information provided when placing an order is complete, accurate and up-to-date. If this is not the case, the Company reserves the right to cancel the order outright.

The order may be placed for a delivery address other than the billing address.

To enable an Internet user to review his/her order before confirming it, Courir has created validation and acceptance screens. The order will not be definitively recorded until the last validation of the payment screen of the validated order. The order is considered validated with the last acceptance click.

Once the order has been placed, the Company will send the Customer an order confirmation e-mail containing a summary of the order and its number. These e-mails will be sent to the e-mail address given when the Customer account was created.

Courir reserves the right to refuse or cancel any order from an Internet user with whom there is a dispute relating to the payment of a previous order as long as this dispute has not been resolved, an incorrect address or any other problem with the Internet user’s account.

The Company reserves the right to refuse or cancel an order if it considers that the Customer is engaging in distribution or carrying out an economic activity using the products thus ordered or for any other reason.

Any request to modify an order may result in its complete cancellation.

5.2 Web order paid in-store:

Web orders paid for in-store include Customer orders placed in-store with the help of a sales assistant via the in-store web shop order interface, via his/her customer account, and paid for directly at the checkout.

The Customer acknowledges having read and accepted the Sales GTCs, when the order is paid at the checkout and validated using the web store order interface. The life cycle of this web shop order remains identical to that of other orders placed directly online.

5.3 E-reservation services:

In-store e-reservation is free and there is no obligation to buy from www.courir.com (excluding sales and products included in the Partner Programme).

The e-reservation service offered on www.courir.com by the Company So Cloz enables the Customer to reserve a product in the shop of his/her choice (among the shops offering the service), subject to the availability of the chosen product in the shop in question. The Internet user must indicate the required size, the shop of his/her choice and his/her contact details. Under no circumstances may the Internet user e-reserve more than three (3) products per day. Once the e-reservation request has been made, the Internet user will receive an initial e-mail acknowledgement of his/her request. A second e-mail and a text message will be sent within two (2) hours, giving a positive or negative response to the request.

If there is no confirmation by e-mail from the selected shop, the request will be considered as not having been taken into account. If the shop validates the request, and once the validation e-mail and text message have been received, the Internet user will be asked to visit the selected shop within twenty-four (24) hours, to collect the item reserved for him/her, and, if applicable, to purchase it directly in-store. Once this 24-hour period has elapsed, if the Internet user has not gone to the shop to pick up his/her reserved item, or in case of cancellation of his/her request in the meantime, the item reserved in advance will be put back on sale in the shop.

The terms and conditions of this service are accessible to the Customer as soon as he/she uses the e-reservation service, available on the product sheet.

The price indicated when requesting an e-reservation on www.courir.com is the price that will be paid for the item reserved in-store by the Internet user, subject to validation of the request by the selected shop.

5.4 Occasional launches of high-demand products

Courir also reserves the right to temporarily exclude a city or country from access to purchase on the courir.com site, if the retailer deems that opening up to this country is detrimental to its business for a given period in an exceptional case. This is particularly the case for Germany, which will be excluded from our delivery countries when high-demand products are launched.

5.4.1 Web orders: Courir by EQL raffles

Courir reserves the right to offer specific products for sale, selected at its own discretion, through prize draws (or “raffles”) organised with the EQL platform. As such, to take part in the prize draw, the Customer is not redirected away from the site but accepts the EQL conditions of use available below.

The opening and closing dates for entries to the prize draws will be defined and communicated by Courir on its social networks.

Raffles organised with the EQL platform remain dependent on the courir.com site, i.e. the retailer, and are limited to the delivery countries available on the courir.com site: France, Germany, Luxembourg and Portugal.

Steps:

1. Creation of an EQL account or connection to an EQL account. The Customer must use the same e-mail address as the one used for the Courir account in order to benefit from an automatic link and the accumulation of points.

2. If a new Customer, a payment method must be chosen and the Customer’s payment information must be provided. The Customer will receive a verification e-mail when the account is created.

3. Confirmation of the following information:

• Size
• Delivery address
• Payment information and 3D Secure verification
4. One-click entry into the prize draw confirmed by an e-mail sent to the e-mail address given when the account was created.

Only one entry per Customer is possible for each draw. Participation is not transferable or assignable to a user other than the one named on the registration form. The draw is limited to one pair per person.
By participating, the Customer hereby agrees to pay the total price due to Courir (including delivery costs and VAT) as calculated at the time of registration.
By registering for the raffle, the user agrees in advance to place an order with Courir if selected. The Courir Web Sales GTCs apply.

5. Up until the date of the prize draw, a Customer may withdraw from the draw for which he/she has registered and cancel his/her participation free of charge. A button is provided for this purpose on the EQL draw page.

6. The draw will take place on the date indicated at the time of registration. The Customer will be notified of the result by e-mail and, if selected, by SMS. The Customer is solely responsible for the information provided when creating his/her account and participating, so that he/she may under no circumstances contest the sending of the results to an incorrect e-mail address or telephone number and claim the product from Courir and/or EQL.

Two possible results:

• The Customer is selected: Once the payment authorisation has been accepted and subject to confirmation that the participant has won, Courir then looks after the order processing, from preparation to delivery, right up to any return/refund. Payment occurs upon dispatch of the order, based on the bank details provided when creating the EQL account. More information in paragraphs 6.3, 8 and 9.
• The Customer is not selected and will have to try his/her luck again in the next draw.

EQL reserves the right to close access to the prize draw form at an earlier time than the scheduled time or to restrict access to the form to certain users if fraudulent behaviour or tampering with the participation process is suspected.

ARTICLE 6 – PAYMENT

6.1 Purchases made on the site directly by the Customer:

Payment can be made online by bank card, COURIR CCC Gift Card or partner gift card (Illicado – this option does not apply to orders placed from Luxembourg and Portugal), Apple Pay, Google Pay, Klarna and Paypal.

• Online payment by bank card

Cards accepted include Visa, Mastercard, CB and American Express. When finalizing the order process, the Internet user is asked to enter his/her bank card number, the expiry date of his/her bank card and the last 3 digits of the security code (CVV) shown on the back of the card.

Online payment by Apple Pay or Google Pay. The Internet user is asked to log in to his/her Google or Apple account, choose his/her desired and pre-registered bank card, and then validate.

Payment for items in the Partner Programme can only be made by credit card.

• Online payment by PayPal

When the order process is finalized, the Internet user is asked to enter his/her login and password on the PayPal interface, and then to validate his/her connection by simply clicking. He/she checks the desired payment amount for the order and confirms the payment by clicking on the button on the PayPal page. Once payment has been validated on the PayPal page, the customer will be redirected to the wwww.courir.com order confirmation page.

• Online via Klarna

By selecting this payment method, the Customer can spread the payment of their order over three (3) monthly instalments, free of charge. Acceptance of the financing request is at Klarna's sole discretion. If the request is declined, another payment method must be selected to complete the order. • Online payment with COURIR CCC Gift Cards

The Courir CCC Gift Card can be loaded with any amount between €5 and €250. You will then be provided with a proof of purchase. It is not personalised, you can give it to the beneficiary of your choice.

By simply inserting its number, the Courir CCC Gift Card enables you to use the available amount to pay for the product(s) of your choice, in one or more instalments up to its value, and possibly complete your purchase with another means of payment accepted by Courir.

• Use of the Courir E-Gift Card:

- The Courir E-Gift Card is accepted on the www.courir.com website and in our shops throughout France.
- The Courir E-Gift Card is considered to be a means of payment. It is not personalised and can be used with other Courir Gift Cards or any other method of payment accepted by our shops in France and available on the www.courir.com website.
- The amount of the Courir E-Gift Card can be freely chosen, with no decimal point and between €5 and €500.
- The Courir E-Gift Card can be used on one or more occasions.
- The balance of the Courir E-Gift Card can be checked on the website or at the in-store checkout.
- The Courir E-Gift Card is valid for 1 year from the date of activation.
- The Courir E-Gift Card is neither exchangeable nor refundable
- All items available for sale on the website www.courir.com and in Courir shops in France can be purchased using a Courir E-Gift Card, except another E-Gift Card.
- The Courir E-Gift Card is acceptable on Partner Program products

• Loss and theft of a Courir E-Gift Card:
- Lost or stolen Cards may be blocked/deactivated by the authorised distributor, provided that the Card is still valid.
- Any amounts already used prior to cancellation cannot be reimbursed.

• Contact and complaints:
- The transactions recorded by the computer systems of the shops and the e-commerce site constitute proof of the transactions actually carried out using the Courir E-Gift Card.
- All claims relating to Gift Cards will be handled directly by the authorised distributor in question.

• Fraud
Groupe COURIR France reserves the right to refuse a Courir E-Gift Card, cancel, or suspend for verification, any order paid with a Courir E-Gift Card, in case of suspected fraud, Card issued in error or for any other violation of the Usage GTCs available on our website via: https://eustore.xyz/fr/conditions-generales-de-vente.html

• Online payment with partner gift cards (not applicable to orders from Luxembourg and Portugal)

When finalizing the order process, the Internet user is asked to use the partner gift card (Illicado, etc.). The Customer must comply with the conditions of use applicable to each of these cards in order to be able to make purchases on the www.courir.com retail site.

• In-store payment

Only web orders placed in-store via the Socloz sales assistant interface can be paid for immediately at the checkout.

• Promotional code

If a Customer wishes to use a promotional code for which he/she is eligible, this code must be entered in the field reserved for this purpose on the shopping basket page. For each commercial transaction, the Customer must refer to the legal notices applicable to the transaction.

• Using myCOURIR points and offers

Customers who are members of the myCOURIR plus loyalty programme will be able to collect points when they purchase certain items on the Company’s website and on products included in the Partner Programme. The terms and conditions can be found on the dedicated page at the bottom of the homepage or directly via the link https://eustore.xyz/fr/cgv-cartemycourir.html. Points are accumulated on the total amount of the order after deduction of any discounts and excluding delivery costs.

Courir reserves the right to make changes to its loyalty programme.

The latest version of the general terms and conditions of the myCOURIR loyalty programme (Start Programme and Plus Programme) in effect is the version that can be consulted on the courir.fr website.Courir therefore asks members to consult the website regularly.

To use these offers, the Customer must link the myCOURIR card number on the back of the card to his/her customer account, which is available in the “myCOURIR” tab. The card will be linked as of D+1. This where the Customer will find his/her current offers and points balance. In order to use these offers, the available codes to be added to the basket must be retrieved from the myCOURIR tab of the customer account.

• Ineligibility to use myCOURIR points and offers

- Guest mode:

An order finalized in Guest mode does not enable the Customer to collect or use loyalty points or benefit from offers reserved for members of the myCOURIR plus loyalty programme who have a customer account. For more details, please refer to article 5.1, Guest mode paragraph.

- Partner Programme:

Products registered under the Partner Programme and shipped by Adidas are not eligible for loyalty benefits.

- EQL by Courir raffles:

Raffle products are excluded from loyalty benefits. To benefit from the automatic accumulation of points on his/her Courir account, the Customer must have used the same e-mail address for the EQL account.

• Payment security

Payments made on the Site are entirely secure.

Thanks to the technical characteristics of the encryption software used on the Site, the bank details (bank card number and expiry date) provided by the Customer cannot be intercepted by third parties. By providing his/her bank details, the Customer accepts in advance and unconditionally that the Company can carry out the secure transaction. The Customer therefore authorises his/her bank in advance to debit his/her account on the basis of the statements sent by the Company, even in the absence of invoices signed by the cardholder. Authorisation to debit the Customer’s account is always given for the amount of the product purchased as invoiced by the Company.

The Internet user’s card number is not automatically saved for future purchases.

• Anti-fraud checks

The Company checks all orders validated on the Site. In this context, checks may be carried out on all bank cards issued outside of mainland France.

In addition, the Company may ask the Customer to provide any documents required to unblock his/her account.

Information relating to the Customer’s order is processed automatically. The purpose of this automated data processing is to define a level of analysis for a transaction and to combat bank card fraud. Failure to transmit data relating to the order will prevent the transaction from being completed and analysed. The occurrence of an unpaid invoice due to fraudulent use of a bank card will result in the details relating to the order associated with this unpaid invoice being recorded in a payment incident file set up by the Company. An irregular declaration or anomaly may also be subject to specific processing. The Courir Group reserves the right to report any fraud to the competent authorities.

6.2 In the case of an in-store order placed by the sales assistant, on behalf of a Customer physically present in the shop:

The Customer pays either by bank card, COURIR CCC Gift Card, or by partner gift card (Illicado, etc.; this option is not applicable to orders placed from Luxembourg and Portugal), Google Pay or Apple Pay, or in cash, using the shop’s checkout system. An order confirmation by e-mail will then be sent to the Customer.

• Use of myCOURIR points and offers:

Customers who are members of the myCOURIR plus loyalty programme can earn points for their purchases. The relevant conditions can be found on the myCOURIR page at the bottom of the homepage. Points are accumulated on the total amount of the order after deduction of any discounts and excluding delivery costs.

For orders placed with the help of the in-store sales assistant via the web store order interface, the myCOURIR loyalty card must either:
- Have been purchased upstream, at the checkout or via a web order, and linked to the web customer account used to place the order.
- Be purchased at the time of purchase via the in-store web order.

Linking the myCOURIR loyalty card to the web Customer account

- A web Customer account already exists: the customer service must be contacted to link the loyalty card to the customer account.

- There is no web Customer account: the Customer must activate his/her e-commerce account via the welcome e-mail received after joining in the shop. His/her loyalty card is automatically attached.

The link will take effect on D+1. Points for purchases made on the same day as the card purchase will be counted, even if this chronology is not respected, if and only if the card is linked on the same day.

The Customer will find his/her purchase history, current offers and points balance in his/her customer account.

6.3 Payment for Courir by EQL raffles:

The only bank cards accepted are those issued by establishments in the following countries: France, Germany, Luxembourg, Portugal.

A 3DS authentication is requested when the Customer’s participation is validated, i.e. confirmation of entry into the prize draw. Subject to acceptance of the payment authorisation and the participant being selected as the winner, the order will be treated as an order placed on the www.courir.com website, so that Courir is solely responsible for processing the order, from preparation to delivery under the conditions set out in Order paragraphs (5.4).

The direct debit will be made when the order is shipped, i.e. approximately 3 days after the end of the prize draw, based on the bank details provided at the time of registration. The invoice is then sent to the Customer by e-mail.

Products sold during “raffles” via EQL are excluded from loyalty, welcome and anniversary tier discounts. The Customer must use the same e-mail address as the one used for the Courir account in order to benefit from an automatic link and the accumulation of points.

Information on returns and refunds specific to EQL can be found in articles 8 and 9.

ARTICLE 7 - DELIVERY CONDITIONS & LEAD TIMES

Deliveries can be made to metropolitan France and Corsica, in addition to the following countries: Germany, Luxembourg, Portugal, Austria, Italy, Denmark, Estonia, Hungary, Slovenia, Sweden, Finland and Malta.

We do not deliver to the French overseas departments and territories and to countries which are not listed above.

For products proposed as part of the Partner Programme, deliveries can only be made in France (including Corsica and Monaco).

Courir also reserves the right to temporarily exclude a town or country from purchasing via the courir.com website if the vendor considers that opening sales to this country would adversely affect its activity over a given period, or in exceptional cases. This is particularly the case when launching high-demand products.

Delivery by Colissimo, DPD and Chronopost to the address requested by the Surfer:

The order is shipped to the address entered by the Surfer when the order. Courir may not be considered liable for the delivery of a package to the wrong address if this error results from information supplied by the Surfer when placing his/her order. Similarly, if it proves impossible to convey the parcel to the Surfer for reasons for which he/she is responsible, the Surfer will reimbursed for the cost of his/her order and the carriage costs where applicable.

Delivery to a pickup point (excluding the Partner Programme and products shipped directly from our stores):

The Surfer has the possibility to choose delivery to a parcel pickup point when placing his/her order. An email will be sent to the Surfer to inform him/her when the parcel is shipped. The Surfer must bring along some currently valid ID to be able to collect his/her parcel from the pickup point. He/she has 14 calendar days to collect his/her parcel. Beyond this deadline, if the parcel is returned to Courir, the Surfer will receive a refund for the cost of his/her order and any carriage costs where applicable. Delivery to a pickup point cannot be selected by the Surfer when the product is a product included in the Partner Programme or when the product is unavailable in our warehouse and is therefore delivered directly by one of our stores.

Delivery to a store (excluding the Partner Programme and products shipped directly from our stores):

In-store delivery is free. The Surfer can choose in-store delivery to a Courir store when placing his/her order. When the parcel arrives in the store, the Surfer will be informed by email and text message, confirming the date on which the order is received. The Surfer must bring along an email or text message confirming that the parcel has been received by the store and some currently valid ID to be able to collect his/her parcel from the store. However, a friend or relative of the Surfer may collect the parcel upon presentation of an email or text message confirming that the parcel has been received by the store, and his/her currently valid ID. He/she has seven (7) calendar days to collect his/her parcel. Beyond this deadline, if the parcel is returned to the warehouse, the Surfer will receive a refund for the cost of his/her order. Delivery in-store cannot be selected by the Surfer when the product is a product included in the Partner Programme or when the product is unavailable in our warehouse and is therefore delivered directly by one of our stores.

Delivery by Colissimo Europe (excluding the Partner Programme):

Home delivery in standard mode with Colissimo Europe. The countries served are: Germany, Luxembourg, Portugal, Austria, Italy, Denmark, Estonia, Hungary, Slovenia, Sweden, Finland and Malta.

Areas excluded: Büsingen, Heligoland, Livigno, Vatican, Campione, Saint Marin, the Faroe Islands, Greenland and the Aland Islands. Courir also reserves the right to temporarily exclude a town or country from purchasing via the courir.com website if the vendor considers that opening sales to this country would adversely affect its activity over a given period, in exceptional cases. Delivery is carried out with Colissimo Europe at a price of €5.90. Delivery is free above €90. For all orders placed from Monday to Thursday (excluding public holidays) the delivery lead times provided for information purposes vary between three (3) and nine (9) working days (please see the table of delivery lead times for Europe below). We do not deliver to the French overseas departments and territories or to countries not listed above.

Delivery of products included in the Partner Programme:

The countries served are: Metropolitan France (including Corsica and Monaco). Home delivery in standard mode with Colissimo Europe or Chronopost in the Paris region. Delivery is made to the following postcodes: - Chronopost - Paris region: 75000-75999, 77000-78999, 91000-95999 - Colissimo: postcodes outside the Paris region. Deliveries are directly organised by the Partner. The order is shipped within two working days (excluding Saturdays, Sundays, German bank holidays and peak periods). According to the chosen partner, the theoretical delivery lead time which applies is 1 to 2 days for Chronopost and 3 to 5 days for Colissimo.

7.2 Delivery lead times

The Customer is informed from the start of the ordering process, and before the order is confirmed, of the estimated delivery lead time for his/her order. The delivery lead times are calculated in working days (on condition that the order is approved by our anti-fraud system. The delivery lead time for the order is calculated taking account of the time required for the preparation and shipment of the order to which must be added the transport time required by the carrier (La Poste So Colissimo, DPD and Chronopost / Mondial Relay pickup point / delivery in-store). In the case of an order placed during the weekend, the day before a public holiday and on a public holiday, the stated lead time is extended by one day. During stocktaking periods the stated lead time may be extended by 1 to 3 days. The delivery lead time is dependent on the delivery method chosen at the time the order is placed.

The displayed delivery fees are the standard rates usually applied. They may temporarily vary in exceptional circumstances, particularly in the event of a health crisis or any other unforeseen situation beyond the Company's control.

7.4 Additional delivery information

The Customer is informed by email when his/her order is shipped.

Whenever a parcel is received by Mondial Relais or in-store, the Surfer will receive an email inviting him/her to come and collect his/her parcel.

In the event of any exceptional stock outages, the Customer will be informed of the cancellation of his/her order by email and if the Customer has already paid (online order placed in-store), he/she will receive a refund for his/her entire order from the customer service department by bank transfer.

The Customer must check the visible condition of the parcel and of the products at the time his/her order is delivered or is collected from a pickup point or in-store.

The Customer must record any noted anomalies in written form on the delivery slip or the document confirming the collection of the order. This verification is considered as having been performed once the delivery slip is signed.

Any request to modify an order will result in its complete cancellation.

ARTICLE 8 – RIGHT OF WITHDRAWAL AND RETURNS

8.1 Time Limits

The Customer has a period of fourteen (14) days to notify their intention to return any product ordered on www.courir.com. In accordance with the provisions of the French Consumer Code, the right of withdrawal is reserved for consumers and does not apply to professionals acting within the scope of their main activity. Consequently, returns of goods purchased by professionals are not accepted by Courir.

If the Customer wishes to return their order in a store located in mainland France and the withdrawal period expires on a Saturday, Sunday, or public holiday, it is extended until the next working day.

Customers enrolled in the myCOURIR loyalty programs benefit from a 30-day period from the date of receipt of the order or in-store purchase.

8.2 Procedure

For products not part of the Partner Program, the customer has two return options:

· Return in a Courir store: the customer may return the product to any Courir store, with their order number.

· Return by post: the customer must go to the "My Account" section of the website www.courir.com, under the "My Orders" tab. There, they will find all their orders and, within the allowed return period, will be able to access a "Make a Return" link from their order summary. If the order was placed as a guest, the return label can only be generated using the link received by email. For more information, refer to Article 5.1.

The customer must then follow the indicated steps:

• Select the items to return
• Choose the return method

The customer must print the prepaid return label and attach it to the package before dropping it off at a collection point. Any item returned by post must be accompanied by the return form. The return shipping cost will automatically be deducted from the refunded amount, up to €4.50. This procedure is mandatory. However, if the customer does not wish to use this service, it is still possible to return the products directly in-store.

The customer must keep the proof of drop-off, dated and stamped by the postal service.

The following products are excluded from in-store returns and can only be returned via postal service, and under no circumstances directly in a COURIR store: list available [here].

The company Groupe COURIR reserves the right to thoroughly examine any return and refund request. In the event of legitimate suspicion of attempted fraud, the Company reserves the right to reject the return and refund of the order in question or to request an in-store return with presentation of a valid ID.

8.3 Packaging

Only products that are returned complete, in perfect condition, and in their original, undamaged packaging and suitable for resale will be accepted. Products and their packaging must be placed in a shipping box for the return.

No return will be accepted unless all these conditions are met.

For textile products, if the plastic sleeve cannot be opened without being damaged, the return will be accepted provided that the label has not been removed and the product is in perfect condition.

Products that have undergone any external alteration or modification may not be returned. Modifications include, but are not limited to: machine washing, cleaning with third-party products, repairs carried out by a third party, etc.

8.4 For Partner Program Products

Returns must be made directly by the Customer, without going through the "My Account" space. Returns initiated by the Customer can only be made via postal service and under no circumstances directly in a COURIR store.

A return label will be included in the package containing the Partner Program product, along with the return instructions.

The label must be affixed to the return parcel, which should be dropped off by the Customer at the nearest post office. This label ensures the package is returned directly to the Partner's warehouse corresponding to the returned product. In case of loss of the label, please contact Customer Service.

8.5 Products Excluded from the Right of Withdrawal

In accordance with the provisions of Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the Customer’s specifications or clearly personalized.

Furthermore, for hygiene reasons and because they cannot be resold, the following products are not eligible for the right of withdrawal once their packaging has been opened: insoles, socks, cleaning products, or other hygiene-related items.

The Company does not accept parcels sent with postage due or cash on delivery.

As part of the prepaid return service, returned products are subject to a quality check upon receipt. If a returned item is deemed non-compliant with the return conditions, no refund will be issued.

In such cases, the Customer will be notified by email and will have the option to retrieve the rejected item at their own expense within 30 days from the date of notification. If no request for reshipment is made within this period, the product will be considered abandoned and no further claims will be accepted.

If the Customer used a prepaid return label, the cost of that label will not be charged or withheld, as no refund is being processed.

8.6 Returns for Courir raffles via EQL

Until the date of the draw, the Customer may exercise their right of withdrawal and cancel their participation free of charge. A dedicated button is available for this purpose on the EQL draw page.

After this date, it will no longer be possible to withdraw from the ongoing draw.

For any complaint related to a dispute, a return, or a refund request, the Customer must first contact Courir’s Customer Service.

Orders resulting from a draw ("raffle") will be automatically refunded via the payment method used to purchase the relevant item (see paragraph 9).

For more information, please refer to paragraphs 5.4 "Order" and 6.3 "Payment".

The return procedure is detailed in Article 8.2.

ARTICLE 9 – REFUNDS

9.1 Return of an online order to the warehouse by post, by the Customer

Return shipping costs by post are the responsibility of the Customer and are not reimbursed. When the Customer uses a prepaid return label provided by Courir, these costs remain their responsibility and are directly deducted from the refunded amount (in the amount of €4.50).

Within 14 business days of receiving the product at the warehouse, if the return is accepted, the refund will be processed:

· If the payment was made via credit card, Google Pay, or Apple Pay, the refund will be issued to the same card.

· If the payment was made with a Courir CCC gift card, the Customer may receive the refund on the same gift card.

· If the payment was made using a partner gift card (e.g., Illicado – this option is not available for orders placed from Luxembourg or Portugal), the Customer may receive the refund either on a Courir CCC gift card or the original partner gift card, via the corresponding customer service.

· If the payment was made via PayPal, the refund will be issued to the same PayPal account.

· If payment was made via Klarna, the refund will be made to the credit card used with the Klarna solution.

Conditions for return acceptance: products must be unused/unworn, with tags still attached, in their original, undamaged packaging, and placed in a shipping box for return – see Article 8.

9.2 Return to the warehouse by post by the Customer of an online order placed in-store through the salesperson using the in-store web ordering interface

Return shipping costs by post are the responsibility of the Customer and are not reimbursed. When the Customer uses a prepaid return label provided by Courir, these costs remain their responsibility and are directly deducted from the refunded amount (in the amount of €4.50).

Subject to acceptance of the return by Courir teams, refunds for returned items will be made as follows: • For payments made by credit card: the refund will be made to the same credit card. • For payments made using a COURIR gift card: the refund will be made to a new COURIR gift card.

Conditions for return acceptance: products must be unused/unworn, with tags still attached, in their original, undamaged packaging, and placed in a shipping box for return – see Article 8.

This refund will be issued within a maximum of 14 days from the date the parcel is received at the warehouse.

9.3 In-store return in mainland France (excluding Partner Program) of a web order

Returns are free of charge for any in-store return within mainland France.

The Customer may return the product in-store in mainland France by presenting it along with the order number.

If the return is accepted by a store located in mainland France (return conditions: product unused/unworn, tags attached, in original undamaged packaging – see Article 8), the refund will be processed as follows:

o Order placed directly by the Customer on the website

· Payment by credit card (including PayPal, Klarna, Google Pay and Apple Pay): the refund will be issued to the same credit card used for the purchase.

· Payment by COURIR gift card: the refund will be issued as a new COURIR gift card.

· Payment by Illicado gift card: the refund will also be issued as a new COURIR gift card.

o Order placed by a store associate on behalf of the Customer via the in-store web order interface

When a Web Store Order is placed, the refund method depends on the store and the payment method used.

General case:

· Payment by credit card: refund will be issued to the same card.

· Payment by COURIR gift card: refund will be issued as a new COURIR gift card.

9.4 In-store return of an in-store purchase

The Customer may return a product to a store in mainland France within fourteen (14) days of the purchase date, accompanied by the product and the original receipt.

The return is subject to the product being in new condition and in its original packaging (see Article 8). The refund will be made using the original payment method: in cash or recredited to the card used.

In case of payment by Courir gift card or partner gift card (e.g., Illicado), no refund in cash or to a bank card is possible; a store credit will be issued in the form of a Courir gift card.

Receipts issued following an exchange do not indicate the original payment method; therefore, refunds following an exchange are automatically issued as a Courir gift card, regardless of the initial payment method.

9.5 Amount of refund for returned items

The refund will include the price of the returned items.

· If the item was purchased with a discount, the discounted price will be refunded.

· In the case of a multi-item promotion, if only one item is returned, the refund will be calculated proportionally, based on the returned item’s share of the original order value.

Non-refundable items: loyalty card.

9.6 The reimbursement of the initial carriage costs

In the case of a return, the refund policy for the carriage costs paid by the Customer when making his/her purchase will be applied as follows (excluding the loyalty card): - Complete return of all items comprising the order: reimbursement of all delivery costs paid. - Partial return of the items comprising the order: no reimbursement of the delivery costs paid will be issued. Partial shipment of the items ordered (excluding the loyalty card) the policy will only apply to the items shipped.

9.7 Refunds for products from the Partner Programme

The issuing of the refund to the Customer may take up to 14 days following the receipt of the product at the Partner's warehouse.

9.8 Refunds for products from the Courir by EQL raffles.

The reimbursement for these raffle type orders will be automatically made using the payment method used to pay for the item concerned. This is dependent on the item concerned being received by our warehouse or in-store and the acceptance of the return by our teams. The customer service department must be contacted beforehand about any dispute concerning the receipt of the product, failing which the return and the refund may be refused.

Further information is available in paragraphs 5.4 Orders, 6.3 Payment and article 8.

ARTICLE 10 - TRANSFER OF OWNERSHIP/TRANSFER OF RISKS

The transfer of ownership of the items to the Surfer only occurs on the day the latter has paid the asking price in full, regardless of the delivery date of the said items.

The transfer of the risks concerning the loss or deterioration of the items occurs at the time of delivery and when the Surfer receives the items.

ARTICLE 11 – GUARANTEES

Legal Guarantee

The Customer acknowledges that he/she loses any right to a guarantee and therefore may invoke none of the guarantees listed below when the purchased product has undergone modification. For information purposes the term "modification" refers non-exhaustively to machine work, cleaning using third-party products, or repairs performed by a third party, etc.

LEGAL GUARANTEE OF COMPLIANCE

Article L 217-4 of the Consumer Code:

The seller is required to deliver a product which is compliant with the contract and is held liable for any lack of conformity existing at the time of delivery. He is also held liable for any lack of conformity caused by the packaging or the assembly instructions, or the installation if he assumed responsibility for this or had it carried out under his responsibility.

Article L217-5 of the Consumer Code:

The item is considered compliant with the contract:

• If it is suitable for the purpose usually associated with such a product and, if applicable:

• If it matches the description provided by the vendor and possess the qualities that the latter has presented to the purchaser in the form of a sample or model;

• If it possess the qualities that a purchaser may legitimately expect in view of the public declarations made by the vendor, by the producer or by its representative, including in the advertising or on the labelling;

• Or has the features defined by mutual agreement between the parties or is suitable for any special requirement of the buyer which was made known to the seller and which the latter agreed to.

Article L 217-12 of the Consumer Code:

Action resulting from a lack of conformity lapses two (2) years after delivery of the product.

Article L 217-7 of the Consumer Code:

Conformity issues which appear within a period of twenty-four (24) months as from the delivery of the item are presumed to exist at the time of delivery unless proof to the contrary is provided. The vendor may contest this presumption if it is not compatible with the nature of the item or the conformity issue.

LEGAL GUARANTEE AGAINST HIDDEN DEFECTS

Article 1641 of the Civil Code:

The seller is bound to a warranty against hidden defects in the thing sold that render it unfit for its intended use, or that so impair its use that the buyer would not have bought it, or would only have given a lesser price for it if he had known of the defects.

Article 1648 paragraph 1 of the Civil Code:

An action resulting from redhibitory defects must be brought by the buyer within two (2) years from the discovery of the defect.

Implementation of the guarantee

To benefit from the legal guarantee of compliance or the guarantee against hidden defects, the Customer must contact the customer service department using the contact form at: https://eustore.xyz/fr/contact-us.html. When these guarantees are invoked, the conditions for processing or covering the cost of the product may vary according to the agreements concluded between the Company and Product Suppliers or Manufacturers.

ARTICLE 12 - COMPLAINTS/INFORMATION

For complaints concerning defective goods received, the Customer must contact the Customer Service Department within the fifteen (15) days following the receipt of the order or its collection from a store.

The entire Website and each of its components are covered by intellectual property legislation, and in particular copyright and rights concerning designs, drawings and models, trademarks, domain names, software or databases, etc., (non-exhaustive list).

The Company may not be considered liable for any interruptions, delays or non-availability affecting the Website due to maintenance work, Internet outages, technical issues, cases of force majeure, action by third parties or any other circumstances.

In as far as possible, the Company will strive to ensure the accuracy and updating of the information published on the Website, reserving the right to correct the content thereof at any time without notice.

ARTICLE 17 – ENTIRETY

In the event that one of the clauses of this contract is found to be null and void as a result of a change in legislation, in the regulations or by a decision of the court, this will in no case affect the validity of or compliance with these General Terms and Conditions of Sale.

ARTICLE 18 - THE “#SHARETHESNEAKERSPIRIT” CAMPAIGN*

Courir would like to showcase its Customers using their content which best conveys the #SneakerSpirit.

The Customers will be contacted by Instagram by commenting on the content selected by Courir. It is hereby understood that the Customer may only grant his/her consent concerning the use of the content if he/she is of legal age and the actual owner of the content in question. Courir may not be considered liable for any authorisation based on erroneous information supplied, or for faults or failings by the Customer.

Once consent has been obtained, Courir reserves the right to establish a link to the published content or to only use the photograph. The content may be used, indifferently and at Courir's discretion, on its websites, on its social networks and in its newsletters or in any other communications. It is hereby understood that these publications may be issued and/or associated with commercial and/or advertising content.

It is hereby understood and accepted by the Customer that the content for which he/she has granted his/her consent is assigned free of charge and that he/she may not directly or indirectly obtain any remuneration on these grounds.

In the event of an order being placed using bots, Courir reserves the right to cancel the order. In the event of the return of an order placed using bots, Courir reserves the right to refuse the return.

Similarly, any attempt to electronically manipulate the following elements:

- modification of IP address (via use of residential proxy) ;

- modification of the user-agent or browser fingerprint;

- automatic captcha resolution;

- manipulation of http requests

ARTICLE 24 – GENERAL TERMS & CONDITIONS OF USE OF THE COURIR GIFT CARD

These General Terms & Conditions of Use of COURIR gift cards are effective between:

Firstly, the company Groupe COURIR, a simplified joint-stock company with a registered capital of 65,665,681.63 euros, having its registered office at 91 avenue Ledru-Rollin, PARIS (75011), France, the unique PARIS T.C.R. identification number of which is 843 726 704, hereafter referred to as the "Company".

And any other natural person visiting or making a purchase via the www.courir.com website or placing an order through a vendor in a Courir store (excluding Outlets) via the said www.courir.com website, from France, hereafter referred to as the "Surfer" or the "Customer").

1. Amount

The Company Groupe COURIR proposes COURIR CCC Gift cards for an amount selected from among those proposed or any amount between €5 and €500 (no decimals).

2. Validity period

The card is valid for one year as from its activation date.

3. Purchasing the COURIR CCC gift card

The purchaser may purchase a COURIR CCC gift card alone or with other products, via the shopping cart.

The COURIR CCC gift card is topped up in a single operation, in euros, to the amount chosen by the person purchasing the card.

Several COURIR CCC gift cards may be added to the same shopping cart for different recipients.

All products can be paid for using the COURIR CCC gift card except another gift card.

Eligibility for free delivery takes into account the total value of the e-card (as with other products).

Loyalty points

The purchaser of the COURIR CCC gift card does not earn loyalty points, the recipient earns them when using the card.

No discounts apply to the purchasing of e-cards.

Important information concerning the country of use

The selected country of use and the country of the recipient's billing address must be identical. Otherwise an error message will appear on the recipient's payment page.

In the event of an error by the purchaser, the country of use cannot be modified. It will be necessary to ask the customer service department to deactivate the COURIR CCC gift card and to issue a new one topped up with the remaining balance, this time with the correct country of use. The Customer must deactivate the card and re-issue a new COURIR CCC gift card for the correct billing country.

The e-card or the physical COURIR CCC gift card may therefore be used:
- In a store in the country chosen when purchasing the card.
- Online with the billing address in the same country (corresponding to the site below).

Optional fields

- Sent to a different email address: the purchaser enters the recipient's email address. Otherwise, the card will be sent to the purchaser's email address by default.
- Scheduled dispatch: the purchaser may select a date and time for the card to be sent. If no date is selected, the card is sent when the order is confirmed. The email may be received later in the event of technical issues.
- Personal message: the message will appear in the email received by the recipient or the purchaser and on the balance consultation page.

4. Acceptance

The Customer acknowledges that he/she has read and accepts the GTCS at the time the payment for the order is confirmed on the website or when the order is paid for in a store.

Any purchases of COURIR CCC gift cards on the website or in-store employs the express and unreserved acceptance of these GTCS.

The COURIR CCC gift card is not issued in a person's name.

The COURIR CCC physical gift card or e-gift card must be stored carefully. No duplicates may be sent to either the purchaser or the recipient. Upon written request submitted to the customer service department, this department may nevertheless supply the information from the COURIR CCC gift card to the purchaser of the gift card.

5. Use

A COURIR CCC physical gift card or e-gift card is valid online and in-store. It can be used for one or several transactions.

Several cards may be used per order.
The COURIR CCC e-gift card may be stored in the Apple wallet.

In the case of an insufficient balance, the payment may be supplemented using another payment method. The sum to be paid will be taken as a priority from the gift card in the case of a partial shipment for example.

Important information concerning the country of use

A country of use based on the recipient's invoicing address is chosen at the time the gift card is purchased.

The COURIR CCC physical gift card or e-gift card can therefore be used:
- In a store in the country chosen when purchasing the card.
- Online with the billing address in the same country (corresponding to the site below).

6. Activating the card

The email containing the COURIR CCC gift card sent either to the purchaser or to the recipient provides access to the activation page. The recipient must click on "Receive your gift card".

Once activated, the recipient can print his/her card.

7. How can it be used?

Online: On the courir.com payment page, select COURIR gift card as the payment method. Enter the numbers shown on your e-gift card in the corresponding field then the PIN.

In one of our shops* : Print the card and pay directly at the till.

8. Viewing the balance on the COURIR CCC gift card

The Customer receiving the card may view the available balance on the dedicated page at the bottom of the website. The Customer must enter his/her COURIR CCC gift card number (e-card or physical card) and the PIN code.

The balance can also be consulted at the till in a shop.

9. Cancellations, Returns and Refunds

Purchasing a gift card

The gift card cannot be returned and no refunds will be issued for it.

In the case of a partial shipment, if products are cancelled by the warehouse, the card will still be sent and debited.

Payments using the gift card

Refunds in the cases of returns to the warehouse, cancellations or disputes will be made to the gift card used for the payment of the items concerned if this is still valid. For a card at the end of its validity period, re-crediting it will extend the card for 12 months. Otherwise a new card will be issued.

For returns to the store, reimbursement may be made by any payment method including the generation of a new gift card. The gift card will not be re-credited.

10. Loss and theft of the card

In the event of loss, the customer service department may supply the information from the card to the purchaser or the recipient upon request, on condition that they provide identification.

Lost or stolen cards may be deactivated or their transactions contested on condition that the Card is still valid. It will be topped up again using a new gift card.

No sums already used before contestation may be refunded.

11. Contact details and complaints

The transactions recorded by the IT systems of the shops and the e-commerce website constitute proof of the transactions actually performed using the COURIR CCC gift card.

In the event of a dispute concerning the balance of the COURIR CCC gift card after its use, for a period of six months as from the contested transaction you may send the receipts from your purchases by post or by registered letter with request for acknowledgement of receipt to the Company COURIR at the following address:

It is very important that the Recipient retains the (physical or virtual) COURIR CCC gift card during the withdrawal period. For a card at the end of its validity period, a top-up automatically extends the life of the card by 12 months.

If the validity period of the COURIR CCC gift card has expired at the time of reimbursement, this will be made through the issuing of a new card.

12. Fraud

The Company Groupe COURIR France reserves the right to refuse, cancel or suspend for verification purposes any gift card order or any order paid for using a gift card if fraud is suspected, if the card has been issued in error or in the wrong name or for any other violation of these GTCS.

13. Personal data

By proceeding to payment, the Customer accepts and acknowledges that he/she has familiarised him/herself with the Data Protection Charter.

The personal data concerning you is collected by the COURIR group exclusively for the provision of the requested service.

And any natural person visiting or purchasing a product at a COURIR store in France, hereinafter referred to as the "User" or "Customer".

ARTICLE 1 – PURPOSE

These terms aim to set out the methods and conditions of sale at integrated and affiliate COURIR stores.

These General Terms and Conditions constitute all the reciprocal agreements between the Company and Customer, who accepts them expressly.

COURIR reserves the right to adapt or change these General Terms and Conditions at any time for legitimate reasons. If a change is made, the General Terms and Conditions applicable in store on the purchase date will apply. However, if a clause is found to be lacking, it will be deemed to be governed by the usual practice in France.

ARTICLE 2 - WHAT WE OFFER

COURIR stores sell shoes, clothing and accessories for people to wear and use for sport and leisure purposes.

The items sold by COURIR stores are those found at the brick-and-mortar locations. These may differ from those at www.courir.com on the day the User views the website.

The purpose of the Courir shops is to offer products for retail sale only and to end consumers who use them for personal purposes and who do not resell them. The company Groupe COURIR therefore reserves the right to refuse or cancel any purchase that does not correspond to a retail sale to an end consumer and/or in the event of abnormal demand, particularly in the case of purchases for quantities and/or amounts that are unusual for an end consumer.

Any purchases made by resellers will result in the deletion of the customer account.

ARTICLE 3 - AVAILABILITY

COURIR may change its store product selection at any time.

The product range includes all styles and sizes in store when the Customer visits. COURIR does not guarantee the availability of any style or size.

Courir reserves the right to limit the number of purchases per customer and/or per order for certain references. This restriction may be applied at its sole discretion and without prior notice.

ARTICLE 4 - PRICE

In-store prices are given by default in euros including all taxes, and apply in mainland France.

Prices in COURIR stores are independent from prices on the retail website.

VAT is at the rate applicable when a purchase is made.

The Company reserves the right to amend product prices at any time, but undertakes to apply the price stated when the Customer purchases, subject to product availability on that date.

If a sale price reduces after a Customer purchases, they have no right to a refund of the difference, no matter the period between the purchase and the price reduction. If a purchased product is exchanged for a different size and the exchanged product meets the conditions in Article 8, the Company undertakes to refund the difference.

Promotional prices are valid while a promotion runs on products included in the offer.

Only one promotional offer can be used at a time.

Product ownership and associated risks are transferred from the Company to the Customer when the Customer pays for and/or takes possession of a product.

4.1 Commercial operations:

Commercial operations at COURIR stores may take various forms and have specific features.

These operations are independent of those carried out on the Company website.

ARTICLE 5 - ORDERS

5.1 Online orders paid for in store:

Online orders paid for in store are Customer orders placed in store with help from a sales assistant using the in-store online ordering interface, linked to their online Customer account, and paid for at the till. The Customer will receive an email confirming the order.

The Customer acknowledges having read and accepted the General Terms and Conditions when the order is paid for at the till and finalised using the in-store online ordering interface. The lifecycle for an online order paid for in store is identical to that for other orders placed online.

For details about placing an online order paid for in store, Customers should see the General Terms and Conditions on the COURIR website.

5.2 Online reservation service:

The online reservation service is free with no obligation to purchase from www.courir.com.

The online reservation service available at www.courir.com provided by So Cloz allows Customers to reserve a product at the store of their choice (from those offering the service in mainland France), subject to the selected product being available at the store in question. Users should select a size and store, and give their contact details. Users cannot reserve more than three (3) products online per day. Once an online reservation request has been made, the User will receive an initial email to let them know their request has been received. A second email and text message will be sent within two (2) hours to tell them if their request has been accepted. If no confirmation email is received from the selected store, the request should be deemed not received. If the request is approved by the store and the second email and text message have been received, the User should visit the selected store within twenty-four (24) hours to collect the item reserved in their name and purchase it in store if necessary. Once the 24-hour window has passed, if the User has not collected their reserved item in store, or if they have cancelled their request in that time, the reserved item will be put back on sale in store.

Details of how this service works are available to Customers in the product information when they use it.

The price indicated when an item is reserved online at www.courir.com is the price that must be paid for it by the User in store, provided that the selected store approves the request.

ARTICLE 6 – PAYMENT

Customers may pay by card, gift card, cash or cheque, or by partner card (Cadhoc, etc.) at eligible stores (see partner website), using the in-store till system.

• Gift cards (excluding OUTLET and COURIR Brest stores)

Gift cards can be loaded with the amount of your choice between €5 and €250. You will then be sent proof of purchase. Gift cards are not linked to a name, so can be given to the recipient of your choice.

Simply show your gift card at the till and use the amount loaded to pay for your product(s) on one or more occasions. You can use another payment method accepted by COURIR to pay for any remaining purchase amount.

Gift cards are valid for one (1) year from the purchase date at all COURIR stores in France.

They may only be used to pay for goods and services at any eligible COURIR store at partner sites and located in mainland France. COURIR gift cards can only be used once they have been activated at a till. They cannot be exchanged for money of any kind, in part or in full—for cash, a bank transfer or a deposit in a bank account—or be subject to a discount.

Gift card use is the card holder's responsibility. Gift cards cannot be replaced or refunded if lost, stolen or expired. They also cannot be exchanged or resold. Gift cards cannot be accepted for purchases over €3000 (Article 1649, Section B of the French General Tax Code).

ARTICLE 7 – MYCOURIR

Customer members of the loyalty programme can earn points from all purchases, excluding those at OUTLET stores. See the terms here, or at https://eustore.xyz/fr/cgv-cartemycourir.html. Points are earned based on total purchase cost after any discounts.

To use an offer when purchasing in store, Customers should show their MyCourir card to the sales assistant, or provide the details needed to identify their MyCourir account (first name, surname and postcode). Customers should regularly check the website for available offers and discounts as sales assistants can only access the points balance at the till. For orders placed with help from a sales assistant in store using the online ordering interface, the MyCourir loyalty card should have already been bought so it can be linked to the Customer's account. The link will complete the day after it is made. Customers can find their order history, current offers and points balance in their online account. For more information about the Company personal data policy, please see Article 12 of the General Terms and Conditions.

ARTICLE 8 - RIGHT OF WITHDRAWAL AND RETURNS

Customers have fourteen (14) clear days after a purchase to visit a store and return a product bought at an integrated or affiliate COURIR store. The purchase receipt and/or invoice must be provided for an exchange or refund to be given. The Company would like to issue a reminder that COURIR stores have no obligation to provide a duplicate proof of purchase if a Customer has lost theirs.

Only items returned complete, in perfect saleable condition and in their original packaging will be accepted. For textiles, if the plastic packaging has had to be damaged to access an item, the return will be accepted as long as the label has not been removed and the product is still in perfect condition.

Products cannot be returned if they have been subject to any outside intervention or modification. The term modification is used for reference purposes and non-exhaustively and includes machine runs, cleaning using third-party products, repairs carried out by a third party, etc.

Products can be exchanged or refunded at any integrated or affiliate COURIR store in the purchase country, excluding OUTLET stores. Refunds are not possible for purchases made at OUTLET stores: only exchanges can be given.

Products that cannot be returned:

In line with the provisions of Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for goods that are made to the Customer's specifications or clearly personalised. Moreover, for hygiene reasons and because they cannot be resold, the following products are not subject to the right of withdrawal if their packaging has been unsealed: insoles, socks, care products and other hygiene items.

In accordance with the provisions of the Consumer Code, the right of withdrawal is reserved for consumers and does not apply to professionals in the context of their main activity. Consequently, returns of goods purchased by professionals are not accepted by Courir.

The following products cannot be returned in store but must instead be returned via a post office, and must under no circumstances be returned directly to a Courir store: list available here.

ARTICLE 9 – REFUNDS

The Customer may return the product to a store located in mainland France within fourteen (14) days from the date of purchase, along with the product and the original receipt. If the return is approved by the store (i.e., the products are unused and in their original packaging – see Article 8), the refund will be issued using the original payment method: either in cash or to the same credit/debit card used for the purchase.

If the payment was made using a Courir gift card (CCC) or a partner gift card (Illicado, etc.), no refund can be issued in cash or to a bank card; instead, a Courir gift card will be issued for the corresponding amount.

For exchange receipts that do not specify the original method of payment, any refund following an exchange will automatically be made in the form of a Courir gift card, regardless of the payment method used for the original purchase.

The refund will include the price of the returned items. If the item was purchased with a discount, the reduced price will be refunded. In the case of a promotional offer based on the simultaneous purchase of multiple items, if only one item is returned, the refund will be calculated proportionally based on the value of the returned item(s) relative to the total amount of the original purchase.

In the case of an online order placed by the in-store seller via the store’s web ordering interface, and returned by post to the warehouse, the refund will be processed by our Customer Service team, who will contact the customer to arrange it either by cheque or bank transfer, depending on the customer’s preference. The refund will be issued within 14 days of the date the parcel is received at the warehouse.

Return shipping costs are not reimbursed in the case of returns made via postal services. If the customer uses a prepaid return label provided by Courir, the return shipping cost will be deducted from the refund amount (€3.90 for Spain and €4.50 for other applicable countries).

ARTICLE 10 – GUARANTEES

Customers acknowledge that they lose all rights to and cannot claim under the guarantees listed below should a purchased product be modified. In this context, "modified" includes being put in the washing machine, cleaned with third-party products, repaired by a third party, etc. This list is non-exhaustive and for information only.

- CONFORMITY LEGAL GUARANTEE

  • Article L217-4 of the French Consumer Code:
  • The seller is obliged to provide a product that complies with the contract. They are liable for any conformity issues that exist on delivery. They are also accountable for conformity issues caused by packaging, assembly instructions or installation where this is their responsibility under the contract or has been carried out under their supervision.

  • A product complies with the contract:

    • If it is fit for the use normally expected of such an item and, if necessary:
    • If it matches the description given by the seller and possesses the features the seller has set out to the buyer in the form of a sample or model;
    • If it has the features that a buyer could legitimately expect in view of the public declarations made by the seller, producer or representative, particularly with regard to advertising and labelling;

  • Conformity issues that begin within twenty-four (24) months of an item being delivered are deemed to have been present on delivery, unless proved otherwise. The seller may challenge this presumption if it is incompatible with the type of item or conformity issue raised.

    ARTICLE 13 - ENTIRE AGREEMENT

    Should a clause in this contract prove to be null and void due a change in legislation or regulations, or to a legal decision, this will not affect the validity or enforceability of these General Terms and Conditions.

    ARTICLE 14 – DURATION

    These terms apply indefinitely until COURIR updates them.

    The date they were last updated is shown on the first page of the document.

    ARTICLE 15 - TRANSACTION CONSERVATION AND STORAGE

    The computerised records stored on the IT systems of COURIR and its partners in reasonably secure conditions will be deemed proof of communications, orders and payments between parties. Purchase orders and invoices are stored in a reliable and durable location, and so constitute a faithful and lasting copy as defined by Article 1348 of the French Civil Code.

    ARTICLE 16 - APPLICABLE LAW – DISPUTES

    The parties agree that these General Terms and Conditions are subject to French law. These terms have been translated into English from the original French. Should a dispute arise, the parties undertake to seek an amicable solution before any legal action. In the event of litigation, the competent courts will be those of France.

    ARTICLE 17 - CONSUMER DISPUTE MEDIATION

    The ruling of 20 August 2015 and decree no.2015-1382 of 30 October 2015 on consumer dispute mediation, acting pursuant to Directive 2013/11/EU of the European Parliament of 21 May 2013 on alternative dispute resolution for consumer disputes, give the consumer the option of using professional mediation to facilitate amicable dispute resolution for any sales at courir.com/fr.

    ARTICLE 18 - GENERAL TERMS & CONDITIONS OF USE OF THE COURIR GIFT CARD

    These General Terms & Conditions of Use of COURIR gift cards are effective between:

    Firstly, the company Groupe COURIR, a simplified joint-stock company with a registered capital of 65,665,681.63 euros, having its registered office at 91 avenue Ledru-Rollin, PARIS (75011), France, the unique PARIS T.C.R. identification number of which is 843 726 704, hereafter referred to as the "Company".

    And any other natural person visiting or making a purchase via the www.courir.com website or placing an order through a vendor in a Courir store (excluding Outlets) via the said www.courir.com website, from France, hereafter referred to as the "Surfer" or the "Customer").

    1. Amount

    The Company Groupe COURIR proposes COURIR CCC Gift cards for an amount selected from among those proposed or any amount between €5 and €500 (no decimals).

    2. Validity period

    The card is valid for one year as from its activation date.

    3. Purchasing the COURIR CCC gift card

    The purchaser may purchase a COURIR CCC gift card alone or with other products, via the shopping cart.

    The COURIR CCC gift card is topped up in a single operation, in euros, to the amount chosen by the person purchasing the card.

    Several COURIR CCC gift cards may be added to the same shopping cart for different recipients.

    All products can be paid for using the COURIR CCC gift card except another gift card.

    Eligibility for free delivery takes into account the total value of the e-card (as with other products).

    Loyalty points

    The purchaser of the COURIR CCC gift card does not earn loyalty points, the recipient earns them when using the card.

    No discounts apply to the purchasing of e-cards.

    Important information concerning the country of use

    The selected country of use and the country of the recipient's billing address must be identical. Otherwise an error message will appear on the recipient's payment page.

    In the event of an error by the purchaser, the country of use cannot be modified. It will be necessary to ask the customer service department to deactivate the COURIR CCC gift card and to issue a new one topped up with the remaining balance, this time with the correct country of use. The Customer must deactivate the card and re-issue a new COURIR CCC gift card for the correct billing country.

    The e-card or the physical COURIR CCC gift card may therefore be used:
    - In a store in the country chosen when purchasing the card.
    - Online with the billing address in the same country (corresponding to the site below).

    Optional fields

    - Sent to a different email address: the purchaser enters the recipient's email address.
    Otherwise, the card will be sent to the purchaser's email address by default.
    - Scheduled dispatch: the purchaser may select a date and time for the card to be sent. If no date is selected, the card is sent when the order is confirmed. The email may be received later in the event of technical issues.
    - Personal message: the message will appear in the email received by the recipient or the purchaser and on the balance consultation page.

    4. Acceptance

    The Customer acknowledges that he/she has read and accepts the GTCS at the time the payment for the order is confirmed on the website or when the order is paid for in a store.

    Any purchases of COURIR CCC gift cards on the website or in-store employs the express and unreserved acceptance of these GTCS.

    The COURIR CCC gift card is not issued in a person's name.

    The COURIR CCC physical gift card or e-gift card must be stored carefully. No duplicates may be sent to either the purchaser or the recipient. Upon written request submitted to the customer service department, this department may nevertheless supply the information from the COURIR CCC gift card to the purchaser of the gift card.

    5. Use

    A COURIR CCC physical gift card or e-gift card is valid online and in-store. It can be used for one or several transactions.

    Several cards may be used per order.
    The COURIR CCC e-gift card may be stored in the Apple wallet.

    In the case of an insufficient balance, the payment may be supplemented using another payment method. The sum to be paid will be taken as a priority from the gift card in the case of a partial shipment for example.

    Important information concerning the country of use

    A country of use based on the recipient's invoicing address is chosen at the time the gift card is purchased.

    The COURIR CCC physical gift card or e-gift card can therefore be used:
    - In a store in the country chosen when purchasing the card.
    - Online with the billing address in the same country (corresponding to the site below).

    6. Activating the card

    The email containing the COURIR CCC gift card sent either to the purchaser or to the recipient provides access to the activation page. The recipient must click on "Receive your gift card".

    Once activated, the recipient can print his/her card.

    7. How can it be used?

    Online: On the courir.com payment page, select COURIR gift card as the payment method. Enter the numbers shown on your e-gift card in the corresponding field then the PIN.

    In one of our shops* : Print the card and pay directly at the till.

    8. Viewing the balance on the COURIR CCC gift card

    The Customer receiving the card may view the available balance on the dedicated page at the bottom of the website. The Customer must enter his/her COURIR CCC gift card number (e-card or physical card) and the PIN code.

    The balance can also be consulted at the till in a shop.

    9. Cancellations, Returns and Refunds

    Purchasing a gift card

    The gift card cannot be returned and no refunds will be issued for it.

    In the case of a partial shipment, if products are cancelled by the warehouse, the card will still be sent and debited.

    Payments using the gift card

    Refunds in the cases of returns to the warehouse, cancellations or disputes will be made to the gift card used for the payment of the items concerned if this is still valid. For a card at the end of its validity period, re-crediting it will extend the card for 12 months. Otherwise a new card will be issued.

    For returns to the store, reimbursement may be made by any payment method including the generation of a new gift card. The gift card will not be re-credited.

    10. Loss and theft of the card

    In the event of loss, the customer service department may supply the information from the card to the purchaser or the recipient upon request, on condition that they provide identification.

    Lost or stolen cards may be deactivated or their transactions contested on condition that the Card is still valid. It will be topped up again using a new gift card.

    No sums already used before contestation may be refunded.

    11. Contact details and complaints

    The transactions recorded by the IT systems of the shops and the e-commerce website constitute proof of the transactions actually performed using the COURIR CCC gift card.

    In the event of a dispute concerning the balance of the COURIR CCC gift card after its use, for a period of six months as from the contested transaction you may send the receipts from your purchases by post or by registered letter with request for acknowledgement of receipt to the Company COURIR at the following address:

    It is very important that the Recipient retains the (physical or virtual) COURIR CCC gift card during the withdrawal period. For a card at the end of its validity period, a top-up automatically extends the life of the card by 12 months.

    If the validity period of the COURIR CCC gift card has expired at the time of reimbursement, this will be made through the issuing of a new card.

    12. Fraud

    The Company Groupe COURIR France reserves the right to refuse, cancel or suspend for verification purposes any gift card order or any order paid for using a gift card if fraud is suspected, if the card has been issued in error or in the wrong name or for any other violation of these GTCS.

    13. Personal data

    By proceeding to payment, the Customer accepts and acknowledges that he/she has familiarised him/herself with the Data Protection Charter.

    The personal data concerning you is collected by the COURIR group exclusively for the provision of the requested service.
